What it really costs to buy at auction in Brazil: commission, taxes, debts and hidden costs
On top of the bid, the buyer typically pays 12% to 20% more: the auctioneer's commission (about 5%), the ITBI transfer tax (2% to 3%), registration (~1%) and, depending on the auction notice, overdue property tax and condominium fees and the cost of vacating. Add everything up before setting your maximum bid — the rule is not to exceed market price minus these costs and the desired margin.
The bid is only the beginning. Whoever compares the bid with the market price and assumes the whole difference is profit discovers, too late, that between 12% and 20% of the value goes to costs — and that some of them can be avoided by reading the auction notice. This is the complete spreadsheet. Values are in Brazilian reais (R$).
The costs every buyer pays
- Auctioneer's commission — 5% of the bid, paid separately (it is not deducted from the bid). It is the most forgotten cost in a beginner's math.
- ITBI — 2% to 3%, the municipal transfer tax, usually calculated on the auction price (some municipalities try to charge it on the assessed value — a common dispute; Brazil's Superior Court of Justice has precedents favoring the buyer).
- Registration and notary fees — ~1% to 1.5% to register the carta de arrematação (judicial) or the deed (extrajudicial) at the land registry, according to the state's fee table.
- Court fees for the carta de arrematação — in the judicial auction, calculated on the value; they vary by court.
The costs that depend on the auction notice
- Overdue IPTU (municipal property tax) — in the judicial auction, the rule is subrogation into the price (article 130, sole paragraph, of the National Tax Code): it is not your problem. In the extrajudicial auction, the edital may transfer it to you. Always confirm the clause.
- Overdue condominium fees — a propter rem debt: if the edital does not assign it to the price, it follows the property. In apartments it is often the biggest surprise — ask the building manager for a statement before bidding.
- Vacating — an occupied property costs time (months until possession) and, often, a cash-for-keys agreement.
- Renovation — you almost never see the interior beforehand. Budget a 5–10% cushion for occupied or old properties.
The exit cost: tax on resale
For the investor, the capital gain on resale is taxed at 15% (up to R$ 5 million) on the difference between the sale price and the acquisition cost — and the acquisition cost includes the bid, the commission, the ITBI and documented expenses. Keep every receipt: each one reduces the tax later. Non-residents are taxed on Brazilian-source gains and should check the rules of their own country and any tax treaty.

If the property is worth R$ 450,000 on the market, the real discount drops from "33%" (in the beginner's head) to 23% — still excellent, but that is the number that should set the maximum bid.
